What are Care Proceedings?
Care proceedings are when the Local Authority have become so concerned about a child that they make an application to the Family Court for a decision to be made by a Judge or Magistrate about whether the child can remain in your care.
These are complex proceedings where the Court will consider the immediate risk of harm to your child and their welfare.
The child’s welfare is the Court’s paramount concern. There are a range of orders the Court can make including Emergency Protection Orders, Interim Care Orders, Interim Supervision Orders or No Order. The Court will also consider carefully alternate placement options within the family.
It is vital you have clear advice and proper representation by specialist solicitors.
If children’s services and the local authority become involved with your family, this can be a very worrying time. It is extremely important you seek advice as soon as possible so you have support liaising with the authorities and full understanding of the implications of their involvement.
